Kipling.Me Terms & Conditions
By registering to become a member (a "Member" or "you" or "your") of Kipling.Me—formerly Kipling Rewards ("Kipling.Me" or the "Program") and by participating in the Program, you (i) represent that you are 18 years of age or older and a resident of the United States, and (ii) agree to the following Program Terms and Conditions (these "Terms"), as well as the other rules, policies, and procedures of the Program posted or otherwise provided by us. Kipling.Me is sponsored by Kipling Retail, LLC ("Kipling"). Capitalized terms have the meaning specified in these Terms.
1. Kipling.Me Overview
When you join Kipling.Me, it allows you to earn Points on your Qualifying Purchases (defined below in Section 3) at Kipling Retail and Outlet stores in the United States only and online at Kipling-usa.com. Kipling.Me does not apply to any other Kipling store or geographic location. Points are earned on an annual basis from January 1 to December 31 ("Program Year"). There are two six (6) month "Rewards Cycles" in each Program Year (January 1 - June 30; July 1 - December 31). At the end of a Rewards Cycle, Members earning sufficient Points, as described below, will earn Rewards Certificates for that Rewards Cycle.
2. Membership
A. Eligibility: You must be at least 18 years of age and a resident of the United States to become a Member. Employees of all VF Corporation brands and individuals receiving a discount or free product to represent a VF Corporation brand are not eligible to join Kipling.Me.
B. How to Join: You may register to become a Kipling.Me Member two different ways:

Online at Kipling-usa.com by creating an account and indicating that you want to be a Kipling.Me Member. Once you've created your Kipling.Me account, you will: earn Points on all Qualifying Purchases at Kipling Retail and Outlet stores in the United States and on Qualifying Purchases made at Kipling-usa.com, be able to access your Member account balance, and view/print your Rewards Certificates to use for redemption. You will also be signing up to receive Program emails and Member Offers as well as general marketing emails.

At any Kipling Retail or Outlet store in the United States only by providing your first name, last name, and email address to sign up to be a Kipling.Me Member. When you register at a Kipling store, you will accrue Points towards earning Rewards Certificates (as described below). You will also be signing up to receive Program emails and Member Offers as well as general marketing emails. You will receive a welcome email containing a link to these Terms and a link to create an account online. Your online account will allow you to access your Member points account balance and see special offers available to Kipling.Me members. As described in these Terms and Conditions, once you have earned enough Points to qualify for a Rewards Certificate, Kipling will send you an email advisory at the end of the Rewards Cycle with your Reward Certificate number and PIN.
C. Creating your online account password: When setting up your online account, it is important that you create a complex password and that you ensure that you do not share your password with others. Both of these measures are your responsibility.
D. Updating information: You are responsible for providing the correct email address to receive Rewards Certificates by email and to ensure proper accounting of Points. As a result, each Member is responsible for maintaining accurate and updated personal information, including your email address. You may update your personal information for your online account online at Kipling-usa.com
3. Earning Points and Obtaining Your Rewards Certificates
A. Shop in the United States at Kipling Retail and Outlet stores or online at Kipling-usa.com and earn Points towards Rewards Certificates in each Rewards Cycle. Your Rewards Certificates can be used towards the purchase of merchandise (including taxes, shipping and delivery charges, gift boxes or wrapping) at Kipling Retail and Outlet stores in the United States or online at Kipling-usa.com. Rewards Certificates are earned as follows:

Subject to the conditions provided in these Terms & Conditions, on any eligible product that is purchased (a "Qualifying Purchase", as further described below), earn: ten (10) Points for every U.S. Dollar spent on Kipling-usa.com or in a Kipling Retail Store; and five (5) Points for every U.S. Dollar spent in a Kipling Outlet Store; provided, however, that the maximum Points that may be applied in any one Rewards Cycle towards the issuance of a Rewards Certificate for that Rewards Cycle, is capped at 10,000 Points. Any Points earned by you in excess of 10,000 in any one Rewards Cycle will be carried over into the immediately subsequent Rewards Cycle.

"Qualifying Purchase(s)" include both regular and sale priced merchandise in Kipling Retail and Outlet stores or online at Kipling-usa.com. Purchases made at Kipling-usa.com will accrue Points when the item(s) ship, not at the time the order is placed. No Points are earned when purchasing Gift Cards from Kipling, but you do earn Points when redeeming a Gift Card at Kipling Retail stores or online at Kipling-usa.com towards the purchase of regular or sale priced merchandise. In addition, no Points are earned for:

Payment of any form of sales tax, shipping charges, gift boxes or wrapping.

Any purchases of Kipling products (1) at Kipling stores outside of the United States, (2) at other retailers that sell Kipling products, or (3) on websites other than Kipling-usa.com

Earn $10 in Rewards Certificate benefits for every 1,000 Points earned in a Rewards Cycle; provided, however, based on the 10,000 Point cap in each Rewards Cycle, the maximum Rewards Certificate benefit that may be earned by you in any one Rewards Cycle is $100. At the end of each Rewards Cycle, Rewards Certificates will be issued in your Account for each 1,000 Points earned (a “1,000 Point increment”). Any Points in excess of a 1,000 Point increment required to issue a Certificate, will carry over into the immediately subsequent Rewards Cycle. No Rewards Certificate will be issued to you in that Rewards Cycle, for any Points that would have otherwise accumulated in that Rewards Cycle beyond the 10,000 Point cap.

Any Points that carry over into the immediately subsequent Rewards Cycle (including any such Points that carry over in excess of the 10,000 Points cap) must qualify to be applied towards a Rewards Certificate in that immediately subsequent Rewards Cycle or they will be forfeited at the end of that immediately subsequent Rewards Cycle.

Rewards Certificates have to be used within one hundred eighty (180) days of the end of the Rewards Cycle in which the Points were earned, after which the Rewards Certificate will expire ("Certificate Use Period").

Provided the Rewards Certificate is used during the Certificate Use Period, it may be used multiple times until the balance has been used.

Any refunds or store credits received for the returns of merchandise after purchase will result in the corresponding Points to be deducted from your Kipling.Me account. Refunds or store credits received in a Rewards Cycle occurring after the Qualifying Purchase was made will be deducted from your Kipling.Me account in the Rewards Cycle in which you receive the refund or store credit.

You will receive an email notice with your Rewards Certificate number and pin (based on your Points total and the Points accrual rules described in these Terms) shortly after each Rewards Cycle ends. Your earned Rewards Certificate will also be posted in your Rewards Account at kipling-usa.com. It may take up to thirty (30) days for Rewards Certificates to be issued at the end of a Rewards Cycle.

Points Redemption Example Scenarios

EXAMPLE 1: You spent $550 US Dollars in Qualifying Purchases at a Kipling Retail store in the United States and you earned 5,500 points. Assuming you had no merchandise returns for store credit or refund in that Rewards Cycle, 5,000 Points will count towards a $50 Rewards Certificate benefits. 500 Points will carry over into the following six-month Rewards Cycle.

EXAMPLE 2: Referring to Example 1, you started the following six-month Rewards Cycle with 500 Points and then spent $600 US Dollars on Kipling-usa.com in additional Qualifying Purchases in that Rewards Cycle, giving you 6,500 total earned Points. However, you also returned $300 US Dollars of merchandise for refund in that Rewards Cycle, which are deducted from your 6,500 earned Points. You now have 3,500 earned Points. 3,000 Points will be applied towards your $30 Rewards Certificate benefits. 500 Points will then carryover into the next subsequent six-month Rewards Cycle.

EXAMPLE 3: Referring to Example 2, you started the next subsequent six-month Rewards Cycle with 500 Points and then spent $325 US Dollars in additional Qualifying Purchases at a Kipling Outlet in the United States and 500 Euros at a Kipling Retail store in Europe while on vacation. Your USD $325 in purchases at the Kipling Outlet in the United States earn you 1,625 Points. Your 500 Euros in purchases at the Kipling Retail store in Europe does not qualify for Points in Kipling.Me. You now have 2,125 Points. 2,000 Points will be applied towards your $20 Rewards Certificate benefits. 125 Points will carry over in the next six-month Rewards Cycle.

EXAMPLE 4: Referring to Example 3, you started the next subsequent six-month Rewards Cycle with 125 Points. You then either made no Qualifying Purchases in that Rewards Cycle, or, even including the Points you did earn for Qualifying Purchases in that Rewards Cycle together with your 125 Points that carried over, you did not reach the minimum 1,000 Point total for the issuance of a Rewards Certificate. The 125 Points that were carried over will expire at the end of the Rewards Cycle. Any Points that you did earn in that Rewards Cycle itself will carry over into the next subsequent six-month Rewards Cycle.

EXAMPLE 5: You begin the Program in January and have spent enough money in the January 1-June 30 Rewards Cycle to earn 10,900 Points. The maximum Points that can be earned by you in any one Rewards Cycle is capped at 10,000 Points. You will be issued a $100 Rewards Certificate for this Rewards Cycle, and it must be used within 180 days of June 30. 900 Points will roll over into the subsequent Rewards Cycle.

EXAMPLE 6: Referring to Example 5, you spend no money in the subsequent (July 1-December 31) Rewards Cycle. Since the minimum number of Points to issue a Rewards Certificate is 1,000, the 900 Points that rolled over will expire at the end of the Rewards Cycle.

EXAMPLE 7: Referring to Example 5 again, you do spend enough in the subsequent Rewards Cycle to earn an additional 15,000 Points. You have 15,900 Points. The 900 Points that carried over from the prior (January 1-June 30) Rewards Cycle PLUS 9,100 of the additional Points earned in the current Rewards Cycle will be applied towards a $100 Rewards Certificate that must be used within 180 days of December 31. Since there is a 10,000 Point cap in issuing Rewards Certificates in any one Rewards Cycle, 6,900 of the Points earned in this Rewards Cycle will carry over into the subsequent Rewards Cycle.

EXAMPLE 8: You begin the Program in January and have spent enough money in the January 1-June 30 Rewards Cycle to earn 25,000 Points. The maximum Points that can be earned by you in any one Rewards Cycle is capped at 10,000 Points. You will be issued a $100 Rewards Certificate for this Rewards Cycle, and it must be used within 180 days of June 30. 15,000 Points will roll over into the subsequent (July 1-December 31) Rewards Cycle. Since any Points that rollover must qualify to be applied towards a Rewards Certificate in that immediately subsequent Rewards Cycle or they will be forfeited--and the Points cap for the issuance of a Rewards Certificate is 10,000 Points—only 10,000 Points that rolled over will be able to be applied towards a Rewards Certificate. 5,000 of the Points that rolled over will be forfeited. Based on Your qualifying purchase activity in this (July 1-December 31) Rewards Cycle, any new Points that are earned will carry over into the next immediately following (January 1-June 30) Rewards Cycle.

B. To log a Qualifying Purchase to your Kipling.Me account, you must provide at the time of purchase the email address that you used to become a Member when setting up your Kipling.Me account. Providing your email address at the point of checkout is unrelated to acceptance of a credit card transaction. If for some reason you did not provide your email address at the time of purchase, you may call Customer Service at 833-874-1048, or submit your request electronically at http://www.kipling-usa.com/on/demandware.store/Sites-kip-Site/default/CustomerService-ContactUs. Upon verification by Customer Service of your Qualifying Purchase and that you did not previously receive Points for that purchase, the Points associated with your Qualifying Purchase will be recognized in your Kipling.Me account.
REMEMBER: If you return a Qualifying Purchase, whether for store credit or refund, the Points you have earned for that purchase (including any bonus Points for designated products, if applicable), will be netted from your overall Program Points total. Points for the returns of merchandise purchased in the prior Program Year will be deducted from your account balance in the current Program Year.
C. Any returns of merchandise may result in a "zero" Points minimum balance if there are not sufficient Points in the Account balance to fully deduct the return.

EXAMPLE 9: You have 1,500 Points. You return $300 US Dollars of merchandise purchased at a Kipling Retail Store for store credit. 3,000 Points are deducted from your Kipling.Me account and you now have a zero balance.
D. Points have no cash value. Also, points are personal to you. You cannot give or transfer your points to anyone else.

It may take up to (5) five days for your Qualifying Purchases to appear online at your Kipling.Me account at Kipling-usa.com.

You will receive an email with your Rewards Certificate (based on your Points total as well as the Points accrual rules described in these Terms) shortly after each Rewards Cycle ends. Your Reward Certificate information can also be found in your account at Kipling-usa.com. Remember: Rewards Certificates must be used within 180 days after the end of the Rewards Cycle in which the Rewards Certificate was earned, after which the Rewards Certificate will expire.

EXAMPLE 10: Your Rewards Certificate for the January 1-June 30 Cycle is issued (i.e., posted in your Kipling.Me account) on July 15. You have until December 27 to use the Rewards Certificate, which is 180 days after June 30 (the end of the Cycle where the Rewards Certificate was earned). If you try to use it on December 28, 181 days after June 30, it will already be expired.

Rewards Certificates may not be used at Kipling stores outside of the United States, at other retailers or stores that sell Kipling products, or on any other websites other than Kipling-usa.com.

Rewards Certificates are promotional items for Members of the Kipling.Meprogram and are not gift cards of Kipling.

Each Kipling.Me Rewards Certificate will contain a unique code that may be used to redeem the Rewards Certificate at Kipling Retail or Outlet stores in the United States or at Kipling-usa.com. If using at a Kipling Retail or Outlet store, at the time of purchase, you'll be asked by the store associate to input the unique code associated with your Rewards Certificate onto the pinpad during checkout. Similarly, if using at Kipling-usa.com, you'll input the code during online checkout.

Rewards Certificates may be redeemed at the same time as using Kipling coupons, certificates, discounts, gift cards, or offers toward the purchase of products. Rewards Certificates have no cash value, are not redeemable for cash, and are not transferable. REMEMBER, Rewards Certificate benefits must be used during the Certificate Use Period or the value will expire. No change/currency will be given for any portion of a Rewards Certificate redemption.

EXAMPLE 11: You would like to purchase a $45 item at a Kipling Retail store and would like to use your $50 in Rewards Certificate benefits. The Rewards Certificate benefits will be debited for the $45, but you must use the remaining $5 during the Certificate Use Period (180 days) or the unused $5 will be forfeited.

If lost or stolen, the code on your Rewards Certificate may be used by anyone, and you are solely responsible for protecting it from unauthorized use. If the unique code for the Rewards Certificate that was assigned to your Kipling.Me account is used in a manner that was not authorized by you, or is lost or stolen, Kipling will not replace the Rewards Certificate.
E. Kipling reserves the right to offer additional Program benefits or decline to offer certain benefits at any time in its sole discretion, with or without notice to you. This could include making bonus points and other promotional offers available to select Members based on purchase activity, geographic location, Program participation, or other information supplied by the Member. Provided, however, once a Rewards Certificate is issued, it will remain available for redemption during the Certificate Use Period. Further, if Kipling intends to make a material change to the value of the Program Points or Rewards Certificates that can be earned or when Rewards Certificates can be used, it will notify Members at the beginning of the Rewards Cycle preceding the Rewards Cycle in which the material change takes effect.

EXAMPLE 12: If Kipling decided that it would now take 500 points to earn a $10 Rewards Certificate, it would notify Members on January 1 that such change would take effect on July 1.
F. Kipling.Me Members may also have early access to special events and be invited to participate in exclusive offers and experiences for Kipling.Me Members (jointly the events and offers are "Member Offers").
4. Email and Privacy
A. By joining the Kipling.Me Program, you agree to receive transactional emails about the Program, such as Program Points acquired, the Rewards Certificates earned, Account password reset, and notifications about your account or changes to the Program (jointly these emails are "Program Emails"), as well as emails with Member Offers from the Kipling.Me Program and/or from Kipling, and general marketing emails from Kipling.
Members may not unsubscribe from Program Emails, but can cancel their membership in the Program as described below in the General Terms. Members may unsubscribe from emails with Member Offers and/or Kipling general marketing emails at any time via the unsubscribe link in those emails.

5. Changes to the Terms
Membership in the Kipling.Me Program and its benefits are offered at the discretion of Kipling, which reserves the right to terminate, change, limit, modify, or cancel any Program Terms, rules, regulations, benefits, or conditions of participation at any time.
We reserve the right, at our discretion, to change, modify, cancel, add or remove any or all portions of these Terms, any policy, FAQ, or guideline pertaining to the Kipling.Me program at any time. The revisions to the Program that Kipling may make include but are not limited to any of the following changes: (i) increase or decrease in the points required or rate at which Rewards Certificates can be earned; (ii) the value of Rewards Certificates that can be earned; (iii) change the method of becoming a Member; (iv) institute or add blackout dates for earning Rewards Certificates. If these Terms change in the future, we will let you know by posting an update to Kipling-usa.com with the most recent modification date. However, if Kipling intends to make a material change to the value of the Program Points or Rewards Certificates that can be earned or when Rewards Certificates can be used, it will notify Members at the beginning of the Rewards Cycle preceding the material change. Any changes or modifications will be effective immediately upon posting the revision and you waive any right you have to receive special notice of such change. By continuing to use Kipling.Me, you agree to the revised terms.
In the event of Program cancellation, Rewards Certificates will be issued according to the current Terms for points earned in the final Program Year.
6. General Terms of the Kipling.Me Program
A. These Terms are void where and to the extent prohibited by law.
B. In the event of a dispute over ownership of a Kipling.Me account, the registration will be declared to have been made by the authorized account holder of the email address submitted at the time of registration. For purposes of these Terms, the "authorized account holder" is the natural person who is assigned to the submitted email address by an internet provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
C. The Program is for end consumers of Kipling product only, and not for commercial (such as “bulk buying”) use. Abuse of the Program by you, including failure to abide by these Terms, purchase or barter of Kipling product in quantities that evidences commercial rather than consumer intent, the sale or barter (or the attempted sale or barter) of Rewards Certificates, Points, or promotional offers, and any misrepresentation of fact relating thereto or other improper conduct as determined by Kipling in its sole judgment may result in cancellation of a Member's Kipling.Me account and future disqualification from Program participation, forfeiture of all Points accrued, and cancellation of previously issued but unused Reward Certificates. At our discretion, we may prosecute abuse of the Program fully of the law.
D. You may cancel your Kipling.Me membership at any time by calling Kipling Customer Service at 833-874-1048, or by submitting your cancellation request electronically at http://www.kipling-usa.com/on/demandware.store/Sites-kip-Site/default/CustomerService-ContactUs. If you cancel your Kipling.Me membership, your accrued Points will be forfeited.
E. Points are not transferable and may not be combined among Members or conveyed by any means to anyone, including through a Member's estate, and may not pass to a Member's successors and assigns. Accrued Points do not constitute property of the Member. Accrued Points are not transferable by the Member upon death, as part of a domestic relations matter, or otherwise.
F. By agreeing to participate in the Kipling.Me Program, you release Kipling Retail, LLC any of its parents, subsidiaries and affiliate entities, and each of the respective, directors, officers, employees and agents of any of the foregoing (the "Released Parties") from all liability with respect to the misdirection or misuse of any Points or Rewards Certificates or the use of any Rewards Certificates by an individual other than the Kipling.Me Member who earned the Rewards Certificate. You further agree through your agreement to participate in the Program to release the Released Parties from and against any and all claims, damages, losses, liabilities, and other expenses (including, without limitation, attorney's fees) relating to your participation in the Kipling.Me Program, use of Rewards Certificates, or agreement to these fTerms.
G. The Released Parties make no warranty, express or implied, including, but not limited to, any warranties of merchantability or fitness for a particular purpose with respect to Kipling.Me, membership in Kipling.Me, or any products or services related to Kipling.Me.
H. The Kipling .Me Program and these Terms will be governed by and construed under the substantive laws of the State of Delaware, without reference to conflict-of-laws considerations. Any claims must be raised and resolved in the federal or state courts located in Dover, Delaware.
I. The Kipling logo, Kipling.Me Program logo, and other logos and taglines are the intellectual property of Kipling Retail, LLC or an affiliate.
7. For California Customers – Notice of Financial Incentive
A. Summary of the program: free-to-join points-based program issuing Rewards 2x year. Points earned for purchases and other engagement opportunities including product reviews, referrals and surveys.
B. Material terms: Please review sections 2. Membership; 3. Earning Points and Obtaining Your Rewards Certificates; and 6. General Terms of the Kipling.Me Program.
The categories of personal information collected to participate in the program are: Name, email address, birth month/day, gender, mailing address, phone, sign-up source, favorite bag, favorite color, survey responses, product reviews written, referrals made, purchase history.
C. Opt-in:

E. We administer the program in accordance with the California Consumer Privacy Act (CCPA).

The value of the consumer’s data collected in connection with the program that forms the basis for offering this program is $3.10. To estimate the value of the consumer’s data, we measured the expenses related to the offer, provision or imposition of the program by GAAP accounting of the cost of acquiring the data divided by the number of program participants.

The value of the program per consumer is $0.34. To estimate the program value per consumer, we measured the accounting value assigned to accumulated points divided by the number of program participants. To estimate the value of the consumer’s data, we measured the expenses related to the offer, provision or imposition of the program by GAAP accounting of the cost of acquiring the data divided by the number program participants.
